An out-of-state subpoena isn’t enforceable in Arizona unless it’s domesticated through the local court. Arizona has adopted UIDDA under Arizona Rule of Civil Procedure 45.1, which allows out-of-state litigants to obtain enforceable subpoenas without appearing in court or hiring local counsel.
To domesticate a subpoena in Arizona:
The clerk will issue an Arizona subpoena that mirrors the out-of-state subpoena.
Once issued:
If an objection is raised, file a motion to quash or enforce in the local Arizona court.
Monitor for Objections – Recipients have 14 days to object or move to quash.
